This policy applies to all Voyqa’s previous, current, and the prospective users/customers that Voyqa aim to acquire in the future. By using the Voyqa services or visiting its website, customer/user agree to this privacy policy by default, hence establishing a legally binding contract under the stipulations of this policy between user/customer and Voyqa as the owner of this Website. Please note that Voyqa policy does not apply to any third-party websites that may be linked to its site and hence, it is strongly advisable to go through and review the Terms & Condition and this Policy before using Voyqa Services.

In dealing with Voyqa including but not limited to using the Voyqa Website or ordering products advertised by Voyqa, User/Customer expressly consent to the Collection, Use and Disclosure of the Personal Information as set forth in this Privacy Policy.

1. Collection of Personal Information

1.1 Information voluntarily disclosed during booking- Voyqa collect information directly from Users, who are of legal age, when they making bookings on this Website. Such information is voluntarily disclosed by the above-mentioned Users and Voyqa may collect and collate the same for business purposes as defined under this Policy.

1.2 Information derived from User activity and usage- Voyqa also collect information via monitoring User activity on its Website, this includes (but not limited to) any express comments, statements, opinions, testimonials shared by them publicly on our Site, forums or any of our social media handles such as Facebook, Instagram, Twitter, etc.

1.3 Information disclosed in correspondence- Voyqa may also collect information that is explicitly disclosed by Users in any correspondence between them and the Website’s staff, owners, operators and chatbot(s) (this includes information disclosed on query, feedback, survey forms and ‘live chat service’ that may be provided on the Website).

1.4 Information tracked through Analytics & Log Files- Voyqa utilize web analytics services such to track and report Website traffic. Voyqa may also create and maintain logs of such information to manage traffic loads and informational technology requirements for providing better service. Voyqa do not link any information gathered in these log files to Personal Information.

1.5 Cookies- Voyqa use software tags known as “cookies”, which are small text files that are transferred from its website. Voyqa use cookies to help them to provide user with a personalized service, and also to help make its website, applications and services better for user/customer.

2. Type of User Information Voyqa Collect

Mentioned below are the major forms or type of User information Voyqa collect, the list is not exhaustive and may not include every type of user information generally collected by similar services (including Voyqa) on the web.

1.   Personal Information- This may include the following (but not limited to), name, email, mobile/phone number, street, city, state, zip code, country, etc.

2.   Billing Information- In case customer purchase a package or subscribe to a paid service, they will need to disclose personal information for billing purposes including the financial information such as debit/credit card, and/or bank details.

3.   Demographic Information- This may include information such as the age, interests, preferences, etc.

4.   IP Address and Browser Information- Voyqa might record the IP information for tracking purposes and derive other details and usage patterns such as, how much time you spend on Voyqa website? What pages and information do you tend to browse?

5.   Device and OS Information- Voyqa might also collect information regarding the type of device user/customer are using to access the web platform including the version of the operating system (Windows, OS X, Android, iOS, etc.). When the user uses the Website through the mobile, Voyqa may receive information about the location and the mobile device, including a unique identifier number for the device. Voyqa may use this information to provide user with suggestions in respect of services if required.

6.   Other Non-Personal Information- When user visit the Website, Voyqa may collect certain non-personal information such as domain and host from which the user access the internet, and internet service provider. This type of information does not identify user personally.

 2.1 Voyqa will not Collect Personal Information secretly or in an underhanded way and will not sell the user/customer Personal Information to any third party.

3. How do we utilize user information?

1.   Interact with user- Voyqa will utilize user information to interact with them in order to render its services. Voyqa will use the information to confirm or notify of any details pertaining to any purchases, booking, etc. Voyqa will also use User information to resolve issues that they may face or report while utilizing the services.

2.   Customize/Improve Services- Voyqa may utilize User information to customize their experience and make changes such as displaying content according to their preferences or interests. Voyqa may use the said information to improve the services and make its website better.

3.   Marketing Purposes- Voyqa may utilize User information for marketing and promotion, for instance, email or SMS marketing to inform about new products, offers or services. Voyqa do not disclose personal information on above-the-line marketing or mass marketing media.

4.   Legal Purposes- Voyqa utilizes User Information to enforce the terms of service and to avoid any fraudulent, prohibited or illegal activities.

5.   In addition to the Purposes outlined above Voyqa use Google Analytics (a web analytics services provided by Google) and data such as age, gender and browsing activity to better understand the behaviour of our customers and provide targeted advertising to suit customers’ interests and preferences.

4. Sharing of User Information (Including Legal Disclaimer)

1.   Voyqa do not share the user/customer personal information with any third-party websites (not associated with us) or social media, nor do they collect information about the visitors from any third-party databases or organizations.

2.   User Information may be subject to partial or full disclosure in order to protect against imminent harm to the rights, property or safety of the Voyqa, its users or the public as required or permitted by law.

3.   Voyqa may share User information with the business partners and service providers such as payment gateways to facilitate transactions in order to deliver the purchased product/service. Please note that our partners may use the information as described in their privacy policies. Voyqa is not to be held responsible for the appropriation of such information by such partners or service providers. Hence, it is highly advisable to go through their policies and terms of use separately.

4.   Voyqa may share User information in case of a legal obligation or to protect itself, where responding to a court order or summons etc. is obligatory and/or mandatory. Voyqa may also share information with government agencies or investigatory bodies under certain contingencies, where Voyqa is legally bound to disclose user information (such as RTI or IT Act, 2000).

5.   Voyqa might also share information, if there is reasonable cause or doubt that may lead to investigating a potential fraud.

6.   Voyqa may Use and/or Disclose your Personal Information for any Secondary Purposes not included in this Privacy Policy if:

(a) The Secondary Purpose is related to a Primary Purpose; and

(b) User would have a Reasonable Expectation that Voyqa would Use the information for that Secondary Purpose.

7.   If the user purchases a product, Voyqa will disclose the name, address and other information necessary to complete the order to the merchant on whose behalf the deal is advertised (the Merchant). Voyqa will use reasonable endeavours to make sure that the Personal Information that we disclose to the Merchant on your behalf is the minimum necessary to complete the order.

 

8.   If the user contact Voyqa to purchase a product over the phone and the user wish to pay by credit card, user consent to Voyqa processing any credit card payment in their capacity as purchaser of the product notwithstanding whether the credit card details that the user provide to Voyqa are their own. If, at the user direction, Voyqa process a credit card payment using the credit card details of any third party who is not the purchaser of the product (the Third Party Payment), the user indemnify Voyqa for all liability including all claims, demands or actions the third party may take against Voyqa with respect to the processing of the Third Party Payment.

 

6. Utilizing user information for security

Voyqa may use User information for securing its website and its clients, as well as itself against security threats. While Voyqa understand the importance of protecting information of its Users and always strive to protect the same against security threats or breaches, however, Voyqa do not take absolute guarantee of protection. Voyqa may post a notice on its website if a security breach occurs. Voyqa may also send an email to the user registered email address to notify them and allowing them a chance to take protective measures.

7. User Consent

By using the Website and/ or by providing the Information, the user/customer consent to the collection and use of such Information in accordance with this Privacy Policy & Disclaimer, including but not limited to the consent for sharing the Information as per this Privacy Policy & Disclaimer. The user/customer specifically agree and consent to Voyqa for collecting, storing, processing, transferring and sharing Information (including Personal Information) related to the user with third parties, service professionals or to registered vendors/users for the purposes as set out in this Privacy Policy & Disclaimer

8. Accessing or updating the user/customer information

As a User of the Website, one can update or modify the Personal Information they have provided. The user may at any time access, delete or change the Personal Information or subscribed services.  

9. Merger, Sale or Insolvency

In case of a contingency where the Voyqa has to file for bankruptcy or a merger and acquisition event, where the assets of the Voyqa are sold or transferred to other organizations, User information will be deemed as Voyqa’s asset and may be held transferrable.

10. Updates to this Policy

This Privacy Policy was last updated on 10/01/2021. Voyqa reserve the right to change its privacy practices. Voyqa will notify its users of any substantial changes to this policy or as required by law.

11. Legal Jurisdiction

Any dispute over Privacy or Intellectual Property is subject to this Privacy Policy and the Website's Terms and Conditions. In case of such a contingency, any disputes arising under this Policy and Terms shall be governed by the relevant laws of India, namely but not limited to the Indian Contract Act, 1872, the Information Technology Act, 2000 (and as amended in 2008), the Companies Act, 2013, the Copyright Act, 1957 and the Trade Marks Act, 1999.

It should also be noted that any international User, visiting or using our services, chooses to disclose their information to an entity in India that is governed by the laws of India. Any issues or disputes pertaining to international Users also fall under the legal jurisdiction of India and applicable laws as described above.
